These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

1. The Promoter:  E. & J. Gallo, Inc. acting from its UK office at 4th Floor Harman House, 1 George Street, Uxbridge, Middlesex UB8 1QQ, United Kingdom
2. Eligibility: This prize promotion is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over excluding employees and their immediate families of The Promoter, associated agents or anyone professionally connected with the prize promotion. No purchase necessary.
3. Promotional Period: The prize draw opens at 00:00 on 18^th July 2024 and close at 23:59 on 14^th August 2024. All entries received outside the Promotional Period will not be accepted.
4. Entry Instructions:  To enter prize draw, text WAFFLE, your first name, surname and postcode with spaces in between (e.g. WAFFLE JOHN SMITH NN45EJ) to 60075 during the promotional period. Entries may only be submitted via text.
5. Participants must have a mobile phone able to send and receive messages to/from 5-digit short codes. Messages charged at network provider’s standard network rate, but there is no charge to the participant for the returned bounce back text message. Texts may not be included in any text inclusive packages, please check with your network provider if you are not sure of your standard network rate.  Users on virtual mobile networks may not be able to text the short code. Please check with your network provider. Text lines are open 24 hours until 23:59 on the closing date. Ask the bill payer before texting. If you text after the closing date, you will not be entered but you will be charged. Take care when entering the text code; the Promoter is not responsible for mistypes and you may be charged at a higher rate. Only correctly submitted entries will be accepted. For the avoidance of doubt, text entries featuring spelling mistakes will be disqualified. Capital or lowercase letters will both be accepted.
6. Entry is by text only. Only one entry per person per week (Monday – Sunday) during the promotional period. For the avoidance of doubt, only one unique mobile number will be accepted per person, and a person can use this mobile number to enter only once per week.

Any entrant using multiple mobile numbers, multiple handsets, multiple identities or computerised or automated systems to enter the promotion will be disqualified and

any prize void. Only one prize can be claimed per household.

7. No third party or bulk entries. Entries via trade, third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter, using identities other than their own, creating fake identities or any other automated or manual means in order to increase that participant’s or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.
8. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
9. Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.
10. Prize Fund: The prize is one of 50 mini waffle makers. Secure UK delivery of all items. 50 prizes in total.

Delivery is available to addresses within the United Kingdom only; Prizes are non-transferable and non-refundable; No cash alternative is available; Due to industry-wide supply chain issues, there may be unforeseen delays to deliveries of physical prizes. We will endeavour to get products delivered to winners as quickly as possible; All prizes are subject to availability. In the event that any of the products listed above are unavailable or in the event of circumstances outside of the Promoter’s control, an alternative product of equal or greater value will be provided; Winners are responsible for ensuring that any delivery note is checked on receipt; The prize excludes anything not expressly listed above.

Please note that all winners will be required to provide proof of full name and age and proof of address for verification before a prize can be dispatched. Proof of identity and address must match the name and postcode provided in the text entry. Only official documents can be accepted as proof of address (driving licence, utility bill less than three months old or bank statement, for example). A mobile phone bill will not be accepted as proof of address.

11. Winner Selection: The 50 winners in total will be drawn via a randomised computer process from valid entries.

50 winners will be drawn from entries received between 00:00 on 18^th July 2024 and close at 23:59 on 14^th August 2024 within 5 working days of 23:59 on 14^th August 2024.

12. Winner Notification: The winners will be notified by text within 5 working days of the draw dates. A winner will be redrawn if they have previously won or if there is a previous winner within their household. It is the responsibility of the participant to ensure that they respond to the winner notification, by emailing the address provided at the point of notification with a scanned copy of their proof of name, age and address. Winners who do not respond within the initial 7 days, will be texted again and given a further 7 days to respond. If contact cannot be made, the winner is ineligible, rejects their prize or their prize is not claimed, within 14 days of the initial prize notification date an alternative winner will be drawn using the same methodology as above. The process will repeat twice for all prizes after which any remaining prizes will be null and void. Entrants are encouraged to monitor their connections during this time in case they are a winner. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion. The Promoter cannot be held responsible for any winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
13. Winners will be sent their mini waffle maker by secure 5 day delivery service within 5 working days of the prize being successfully claimed.
14. The Promoter’s decision is final and binding. No correspondence will be entered into.
15. The Promoter will make available a list of winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting waffle@altavia-hrg.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing waffle@altavia-hrg.com. The Promoter reserves the right to refuse such requests.
16. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Those who try and circumvent the entry process and/or entry instructions by any method or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means will be disqualified and any prize award will be void.
17. Entry into the Promotion is at the entrant’s sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these Terms and Conditions shall act to limit or exclude the Promoter’s liability resulting from its negligence or fraud.
18.  The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
19. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion or invalidate any entries in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other event that is beyond the control of the Promoter.
20. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
21. The application and interpretation of these terms and conditions shall be governed by the law of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them unless you live in another part of the UK, in which case your local courts will have jurisdiction.
22. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your data will be passed onto a third-party fulfilment service provider for the purposes of administering the prizes. This data will be kept secure and in accordance with the requirements of current Data Protection legislation. Entrants’ personal data will be used and held in accordance with the Promoter’s Privacy Policy at Privacy Policy | E. & J. Gallo Winery. Data will be stored for 3 months after the promotion end date then deleted. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to waffle@altavia-hrg.com By participating in the promotion, you agree to the use of your personal data as described here.
